Cyber-squatter owns diddly-squat in domain ruling
Sir Richard Branson has wrestled a .xxx domain off a cybersquatter in a challenge over richardbranson.xxx.
The Virgin Group founder discovered last week that his Uniform Domain Name Dispute Resolution Policy complaint with the World Intellectual Property Organisation was successful.
The WIPO panelist handling the case found that the cybersquatter, Australian Sean Truman, lacked rights to the address and had registered it in bad faith.
Truman, who bought the domain four days after the .xxx registry went live last December, said in his defence that he snapped up the address as a "souvenir". He also claimed that Branson had "ample opportunity to register the name if he believed that his rights may be under threat by another person", according to the decision.
But "you snooze, you lose" is not a defence to cybersquatting under the UDRP's rules, and the panelist found in favour of Branson. The domain will now be transferred to Virgin.
But because Virgin is not a porn company, and therefore does not qualify to register .xxx domains, richardbranson.xxx will likely be set as a "non-resolver", meaning it will not work when you type it in your browser address bars.
It is the second UDRP case to have been decided since .xxx first started selling domains last year. The first saw the domain heb.xxx transferred to a Texas-based grocery chain. Other disputed addresses include foxstudios.xxx and kayjewelers.xxx, according to UDRP records. There have been 13 cases filed since 29 December.
Uniquely, the .xxx space has a second way of resolving cybersquatting disputes that is much faster, more secretive, and turning out to be just as popular as the standard UDRP.
This Rapid Evaluation Service, which can take down an obviously cybersquatted domain in as little as two days, has been invoked 15 times so far, according to the National Arbitration Forum, which handles the cases. NAF has taken down 12 .xxx cybersquats since December, according to recently released statistics. Each case took on average two days for a preliminary decision.
Unlike UDRP, which transfers the domain to the aggrieved party, domains seized under the $1,300 RES are turned off permanently, so the winner does not have to pay annual recurring fees.

Virgin Gaming, the online tournament gaming division of Richard Branson’s Virgin Group, has announced that it has snatched more than a million registered users for its prize-based online gaming tournaments.
Virgin has awarded more than $7 million in cash prizes. Four million game challenges have been issued and players are spending an average of 72 minutes per visit to the Virgin Gaming website as they play hardcore console games such as Electronic Arts Madden NFL 12 or Take- Interactive’s NBA 2K12.
“The numbers are increasing on a daily basis,” said Billy Levy, co-founder of Virgin Gaming and president of the group. “More than 700,000 of those players have signed on in the last four months.”
More and more publishers are adding new options for tournament play through the Virgin Gaming site. Besides EA’s EA Sports and Take-Two’s 2K Sports, other partners include Sony PlayStation, Ubisoft and GameStop.
“We knew we were on to something and that our service had significant potential, we just didn’t realize it would take off as quickly as it did,” said Rob Segal, chief executive of Virgin Gaming. “Our team continues to evolve the experience on a daily basis, and user feedback has been a key component in our upgrades.”
Virgin Gaming’s tournament play is integrated directly inside the games. The service can match similarly ranked players in tournaments. It can report the results of matches, categorize players into rankings, process secure payments, and provide customer support. Players can compete for online cash, knowing that cheaters will be rooted out of the system, since Virgin offers a “fair play guarantee” with automated game results validation.
Virgin commenced the service in June 2010. But Levy said the team worked out the kinks for a period of time and the biggest games have really ramped up in more recent times.
Virgin Gaming is now running the Challenge Series tournament on the PlayStation 3, where players are competing in Madden NFL 12, NHL 12, and FIFA 12 for a chance to win over $1 million in cash and prizes in a single tournament. That’s the largest prize money ever for a console-based sports tournament. That tournament will end in April with live finals in New York.
When that happens, Virgin Gaming will begin to compete with Major League Gaming, which sponsors both online and live tournaments around the country. The tournaments can involve players of all skill levels, not just professional gamers. GameStop is also involved in a $100,000 Gridiron tournament with 30,000 players.
“That shows our system can really scale up to large tournaments,” Levy said.
What really helped the tournaments take off was the introduction of “asynchronous play.” In previous tournaments, players had to start playing at 7 pm at night and keep playing all night until they lost.” But now, you can play a game at a time of your own choosing, as long as you can find another player of your same rank at that time. That gives players more flexibility about when they have to play in the tournament.
Levy advised that the tournaments are starting with online gaming but could be expanded to mobile and social games, where the company would compete with King.com, Worldwinner and GameDuell.
Levy started the company with his buddy Zachary Zeldin in 2007 during their days at a university in Florida. They followed some of the live tournaments but found those games were dominated by superstars. There wasn’t really a tournament gaming business for ordinary gamers. So they started one and teamed up with Segal, who ultimately introduced them to billionaire Richard Branson.
Branson was actually an early pioneer in video games. His company formed Virgin Games in 1981. The company made acquisitions and steadily expanded its operations, renaming itself Virgin Interactive in 1994. It fostered some great talent such as David Perry, Louis Castle, and Brett Sperry. Sperry and Castle’s Westwood Studios made memorable games such as the real-time strategy games Dune II and Command & Conquer. But Virgin also made some major duds, such as the movie-based game Demolition Man. In 1998, Virgin sold the game company’s U.S. assets to Electronic Arts, while it unloaded the British game studios in a management buyout.
If Virgin Gaming keeps growing, then Branson will be happy he got back into gaming.

Wednesday 25th January, 2012: Virgin Games, the leading online gaming company, has launched a brand new television advertising campaign for its bingo site – Virgin Bingo.
The latest advert is part of a £500,000 marketing campaign to run in the first quarter of 2012. It is a new concept for Virgin Bingo and is a departure from its previous animated advertisements. The new ad takes on a Willy Wonka meets Virgin theme. Staged in an imaginary factory where Virgin Bingo is made, a woman is taken on a backstage tour of the fantastical premises where Oompa-Loompas have been replaced by happy, dancing Virgin staff. The new commercial also introduces Virgin Bingo’s new welcome bonus: “Deposit £10 and play with £35”, as well as new exclusive Virgin Group prizes.
The campaign focuses primarily on women aged between 25 and 54 - the core target market for online bingo - with day time scheduling on channels such as Five, a range of Sky UK and ITV digital channels.
The 30 second advert was produced by ABF Pictures with Manning Gottlieb OMD acting as media planners and buyers. The advert is scheduled to run for multiple campaigns throughout the year across both terrestrial and freeview channels.

Today we had the enormous pleasure to expience Tubular Bells For Two in person at the Seymour Centre in Sydney.
If the name, "Tubular Bells" (For Two) sounds familiar, it should.
The original version by legendary musician Mike Oldfield has been used in many movies and is often referenced in media, and is also understood to be the breakthrough artist signing of Richard Branson's Virgin Records back in 1973.
Daniel Holdsworth and Aidan Roberts did a supurb job of entertaining and informing media types who witnessed their magic early today at the Seymour Centre.
It was two artists (bordering on musical genius we think), and 22 instruments, as they performed both 'Tubular Bells' and the somewhat less famous, 'Caveman'. On conclusion numerous media introduced themselves and complimented them on their ultra impressive contribution to the Sydney Festival.
Aidan explained "We started 10 years ago on trumpet and just kept adding instruments".

Aidan is the principal songwriter and multi-instrumentalist for the folk-rock band The Maple Trail (Broken Stone Records). He has toured Australia and the United States and released the albums Dirty Echo Spark (2007), Radio Twilight Lost (2008). Aidan is also a contributing songwriter and guitarist for popular psychedelic rock outfit Belles Will Ring (Remote Control Records), who have released the albums Mood Patterns (2007) and Broader Than Broadway (2008), and have toured Australia regularly, performing at festivals such as The Big Day Out. Aidan has also written and performed scores for theatre, including King Lear (2006, Harlos Productions), Titus! The Ultimate Murder Ballad Musical (2006, Gumption Ubertheatre), Hamlet (2009 and 2010, Harlos Productions), and Tattoo (2009, Griffin Theatre). He is a member of Sydney based folk-psych-country outfit The Maple Trail, and plays lead guitar in the acoustic trio Ten Thumb Tom. As a session musician, Daniel has recorded and performed with the likes of Yothu Yindi, and recorded for TV productions such as Blue Heelers. Since 2008, Daniel has been the musician for William Yang’s My Generation, a theatrical piece that explores life within the Sydney arts community in the 1970s and 1980s. During 2009, Holdsworth was composer and musical director for the Acting Factory’s children’s production of Hansel and Gretel. Tubular Bells is the debut record album of English musician Mike Oldfield, released in 1973. It was the first album released by Virgin Records and an early cornerstone of the company's success. Vivian Stanshall provided the voice of the "Master of Ceremonies" who reads off the list of instruments at the end of the first movement. The opening piano solo was used as a soundtrack to the blockbuster William Friedkin film The Exorcist (released the same year) and gained considerable airplay because of this.
The piece was later orchestrated by David Bedford for The Orchestral Tubular Bells version and it had three sequels in the 1990s, Tubular Bells II (1992), Tubular Bells III (1998) and The Millennium Bell (1999). Finally, the album was fully re-recorded as Tubular Bells 2003 at its 30th anniversary in 2003. A newly mastered and mixed re-issue of the original album appeared in June 2009 on Mercury Records, with bonus material. On 6 June there were international bell-ringing ceremonies to promote the release.

Today we had the enormous pleasure to expience Tubular Bells For Two in person at the Seymour Centre in Sydney.
If the name, "Tubular Bells" (For Two) sounds familiar, it should.
The original version by legendary musician Mike Oldfield has been used in many movies and is often referenced in media, and is also understood to be the breakthrough artist signing of Richard Branson's Virgin Records back in 1973.
Daniel Holdsworth and Aidan Roberts did a supurb job of entertaining and informing media types who witnessed their magic early today at the Seymour Centre.
It was two artists (bordering on musical genius we think), and 22 instruments, as they performed both 'Tubular Bells' and the somewhat less famous, 'Caveman'. On conclusion numerous media introduced themselves and complimented them on their ultra impressive contribution to the Sydney Festival.
Aidan explained "We started 10 years ago on trumpet and just kept adding instruments".

As I look out across the ocean, savoring another sunset on Necker Island, I find myself reflecting on a busy and exciting year for myself and the Virgin Group. There were a couple of setbacks: In January, I ruptured a cruciate ligament in a ski accident, which meant that I had to travel to France and South Africa on crutches; in August, a fire here destroyed the great house. But we have ended 2011 in a much happier way, with my daughter Holly’s wedding to Fred Andrews, a shipbroker. This seems a good time to jot down a few of the year’s highlights.
I have written previously that success cannot be measured in wealth, fame or power, but by whether you have made a positive difference for others. The accomplishments of the past year of which I am most proud involve my efforts to raise awareness of and financing for Virgin Unite, along with the new philanthropic ventures we launched.
Because it is our responsibility as entrepreneurs and business leaders to tackle the issues our society faces, from climate change to poverty. To find solutions, we at Virgin have had to consciously cast aside traditional thinking, form unusual partnerships and consider unorthodox answers. Here are some of our most effective actions:
1. Taking the initiative.
The Carbon War Room is a business-focused, global NGO we set up three years ago to find profitable solutions to tackling climate change: Our society does not have to make a choice between economic growth and saving the environment. CWR is a nonprofit fixated by profit.
We made great progress over the past 12 months. Rather than waiting for governments to work out policy solutions, the CWR team launched two game-changing websites: one to promote efficiency in shipping; another to rank and chart the latest in sustainable aviation biofuels.
Earlier this year CWR launched a program to help finance energy-efficient retrofits of buildings, which was kicked off with a
$650 million investment scheme in Florida and California.
2. Reducing, reusng, recycling and planning for the future.
We must also ensure that we conserve our planet’s resources and maintain diversity. This year Virgin Unite struck up a great partnership with WildAid to campaign for the banning of shark-finning, the barbaric and wasteful act of cutting a fin off a living shark.
WildAid estimates that 73 million sharks per year are killed for this dish.
This project is in its early days but we are making great progress, thanks in part to the support of Governor Jerry Brown of California, who signed a bill banning the sale and possession of shark fins.
Already, many top restaurants and hotels no longer serve shark-fin soup.
3. Championing unconventional solutions.
Over the past 50 years, drug usage has gone up and jails have filled.
Though millions of taxpayer dollars have been spent trying to stamp out this illicit trade, the prohibitions have merely fueled organized crime. It is time that we try an alternative approach. This year I was fortunate to be part of the U.N. Global Commission on Drug Policy, which found that the costly war on drugs has backfired, producing little to no results.
A decade ago, Portugal became the first European country to officially abolish all criminal penalties for personal possession of drugs – a brave and successful policy. Jail time was replaced with offers of treatment for addiction: many critics feared this would attract “drug tourists” and exacerbate Portugal’s drug problem.
The results of a report commissioned by the Cato Institute in April this year suggest otherwise. It found that in the five years after personal possession was decriminalized, illegal drug use among teens in Portugal declined and rates of new HIV infection caused by sharing of dirty needles dropped, while the number of people seeking treatment for drug addiction more than doubled.
Portugal’s brave stand amounts to a decision to “Screw Business As Usual” – the title of my latest book and a mantra that should be adopted by people holding positions in company boardrooms and government cabinets the world over.
4. Building for the future.
Virgin businesses have always emphasized the need to challenge the market and do things differently – values we are keen to share with a new generation of entrepreneurs in the developing world. In 2011 we continued to expand our efforts, launching the new Branson Centre of Entrepreneurship in Jamaica and moving our center in Johannesburg to new premises, under a new CEO. Both centers are focused on helping young entrepreneurs to expand their businesses by offering practical advice and mentoring.
I brought groups of business people to South Africa and Jamaica to meet our entrepreneurs; as always, the visitors were bowled over by the young entrepreneurs’ enthusiasm and passion for their work. We hope to expand our efforts further and to find financing and maybe obtain government help in scaling up these centers.
Our society’s social, environmental and financial problems remain challenging and it looks like next year will be a tough one on many fronts. We will need to look for bold solutions, because change means opportunity. Whether you can effect small changes at the local level or try to push for sweeping cultural shifts in your industry or sector, 2012 – now – is the time to make a difference.

As the fourth richest man in the United Kingdom, Sir Richard Branson is not part of the "99 percent," a phrase coined by the "Occupy Wall Street" protesters to describe those making less than the richest one percent.
But the Virgin boss and self-made billionaire has empathy for protesters currently making headlines all over the world, FOXNews.com reported Tuesday.
"It is a very positive movement, it's a peaceful movement and it needs to make businesses all over the world sit up and listen," Branson said at the Rock the Kasbah party in support of his non-profit Virgin Unite foundation in Hollywood.
He said his new book, titled "Screw Business as Usual," actually has a message similar to that of the protests.
"Basically its saying that business should come to be a force for good, it should get out there and tackle the problems of the world," he explained. "In that way, it hopefully can regain its reputation and the need to 'Occupy Wall Street' will be less."
Branson also said he is optimistic that the movement will have a positive impact in turning the corporate world around for the better.
"It should happen in packs and I really think its capitalism is going to have a good name rather than a bad name," he said. "It's up to the people who are lucky enough to be in a position of power through businesses to utilize that power responsibly that's so very, very important."
As a teenager, Branson spent time running from police wielding batons as he marched on the American embassy in England in an effort to try to stop the Vietnam War.
"I'm a lad of the 60s and I think we had a social conscience in those days," he recalled. "So from quite a young age I set up an advisory for the young people and through the advisory center I got a great understanding of people who were struggling in life, and I'm in a position where I can make a real difference and I'm determined to make a real difference."

Broccoli’s Eon Productions, Metro-Goldwyn-Mayer Studios, and Sony Pictures Entertainment, is directed by Academy Award® winner Sam Mendes and stars Daniel Craig, who returns for his third film as James Bond 007. The screenplay is written by Neal Purvis & Robert Wade and John Logan. SKYFALL, which goes into production on Monday, November 7th, will begin its worldwide roll-out in the UK and Ireland on October 26th 2012 and in North America on November 9th 2012.
Joining Michael G. Wilson, Barbara Broccoli and Director Sam Mendes were members of the cast of SKYFALL, including: Daniel Craig, Javier Bardem, Dame Judi Dench, Naomie Harris and Bérénice Marlohe. The filmmakers also announced Ralph Fiennes, Albert Finney and Ben Whishaw.

James Bond in bed again with Virgin Atlantic; Virgin back after Casino Royale - 21st November 2011
James Bond is flying again with Richard Branson's Virgin Atlantic, after the airline inked a new sponsorship deal for the highly anticipated 007 movie Skyfall.
Years again 007 preferred British Airways but things can change over time, and when the price is right.
Daniel Craig is understood to have excited Branson's Virgin in Casino Royale, and that's when the first Virgin Atlantic deal with the Bond franchise came to pass.
Not only did Bond pick up a Virgin Atlantic frequent flyer card, but Branson snatched a brief cameo in that first Daniel Craig 007 film.
Some viewers may recall the scene as one of Bond's enemies enters Miami Airport to plant a bomb on a 'Skyfleet' plane.
The villain walks through the security gate on the left, while a passenger standing arms-spread on the right is sneaky Branson.

SKYFALL, which goes into production on Monday, November 7th, will begin its worldwide roll-out in the UK and Ireland on October 26th 2012 and in North America on November 9th 2012.
Joining Michael G. Wilson, Barbara Broccoli and Director Sam Mendes were members of the cast of SKYFALL, including: Daniel Craig, Javier Bardem, Dame Judi Dench, Naomie Harris and Bérénice Marlohe. The filmmakers also announced Ralph Fiennes, Albert Finney and Ben Whishaw.
In SKYFALL, Bond’s loyalty to M is tested as her past comes back to haunt her. As MI6 comes under attack, 007 must track down and destroy the threat, no matter how personal the cost.

The Editor is Stuart Baird, A.C.E., whose many credits include Casino Royale. Jany Temime, whose many credits include the Harry Potter series, In Bruges, and Children of Men, is the Costume Designer. Sir Richard Branson: Why my friend is dying for a change in organ donor law, by Richard Branson - 17th November 2011

I’m quite used to people approaching me in the street for help. It’s what happens when you have a recognisable face.
But from the outset, Fiona Hills was different.
She came up to me as I strolled along Notting Hill Gate in London three months ago.
I was immediately taken by her – she was a vibrant, smiling, kind, happy, thoughtful person.
That made her story even more heartbreaking.
Fiona said she was terribly sorry to bother me but explained she had a liver disease and would die unless she could get a liver transplant.
She went on to tell me how 1,000 patients die needlessly every year while awaiting life-saving transplant surgery because of a lack of organs.
She had written to David Cameron but got no response and hoped maybe I was in a position where I could cut through the bureaucracy and get things done.
Fiona told me that, while 90% of the population support organ donation, just 29% are officially registered.
As I stood chatting to her in the street, I was embarrassed. I admitted that I had never signed up and did not have a donor card despite wishing to donate my organs when I die.
It had crossed my mind and was something I had debated over the years and therefore I felt guilty that I had not done something about it.
Then Fiona explained the proposed opt-out system to me, which makes carrying a donor card redundant.
This system, also known as ‘presumed consent’, is used with great success in other European countries, including France, Spain and Austria.
It is incredibly simple and saves thousands of lives every year.
Under the system, every person who dies is a potential donor unless they opt out from the transplant register.
As a result, the waiting lists for organs in these countries have all but disappeared.
As I stood listening to Fiona, it became screamingly obvious the same thing needs to be adopted here – and quickly.
That’s why I decided to launch a campaign for a change in the law, making it easy for everyone to become a donor unless they do not wish to be one.
When my father Ted died in March, aged 93, despite the fact that he wanted to become a donor no one asked us and in truth it was the last thing on our minds at the time.
Looking back, I know he’d have loved the idea of helping someone else and living on through them.
Britain has one of the lowest donor rates in Europe, with just 13 people out of every million donating organs.
People are dying completely unnecessarily in the UK because the wrong system is in place.
When people die they either go to a crematorium or are buried and their organs go to waste, organs which could save somebody.
Fiona is 42 and suffering from end-stage liver failure as a result of a genetic condition, auto-immune hepatitis.
She was placed on the transplant list in 2009 when her condition deteriorated and now lives in constant pain, spending three days every six weeks having six litres of fluid drained from her abdomen.
It just seems sad to think Fiona could die in a few years, yet with a slight change in the law she will be kept alive. The current UK system also puts young doctors and nurses in an awful position.
They face the prospect of asking relatives if they will allow the person they’ve just lost to be an organ donor. I cannot think of a worse question to have to ask, or indeed a worse time to ask the question.
As a result, many medical professionals simply don’t have the courage to ask or feel it is too inappropriate.
I have since spoken to my family about it and will do my best to always carry a card.
But realistically the law needs to be changed so people don’t have to think about always carrying a donor card.
When Gordon Brown was Prime Minister, he tried to introduce presumed consent.
Sadly, the law was never changed after objections from Muslim and Catholic groups.
But as I see it, if someone has a religious reason – or any other reason for that matter – why they wish to opt out then fine, they can.
I am writing to David Cameron and Health Secretary Andrew Lansley to ask for their support.
The number of patients in the UK awaiting transplants is staggering.
There were 6,920 waiting in 2009, according to the NHS Blood Transplant Organ Donation and Transplantation Directorate.
The majority of those were on dialysis costing £193million a year. If they had received a transplant, the annual cost would be £41million – a £152million saving to the NHS.
The fact the Mirror is helping to highlight the issue is fantastic and will help enormously.
The important thing is that organs are found for those who are in desperate need today. We will keep up the pressure and I urge Mirror readers to do the same by sending their messages to my foundation, Virgin Unite.

The Battlefield 3 Worldwide Conquest Tournament helps EA compete with Call of Duty Elite, Activision’s social service which also includes a competitive gaming element with prizes up for grabs, according to Virgin Gaming.
“We don’t view Elite as a threat,” Virgin co-founder Zachary Zeldin told the press.
“We view it as one of the top industry leaders taking notice of what Virgin Gaming is doing and trying to implement it themselves. Which is great. We wish them nothing but success. I wouldn’t be surprised if Activision was a part of Virgin Gaming next year.
"We are very excited to see how Elite is going to do and how the community is going to receive it, are they going to view it as too hardcore? Or too expensive? It is going to be trial and error for Activision in the first year and I am excited to see it.”
The company says it has hit the jackpot with its official $1.6m Battlefield 3 gaming tournament.
The online competitive games specialist claims its EA deal has opened doors for them, helping the outfit score major clients such as 2K Games, THQ and Codemasters.
The company will give away some £2.6m in prizes to its members over the next 12 months. And it promised that its service can help sell DLC and keep developers’ games out of the pre-owned bins.
“When a company like EA trusts you with their $1bn IP, people see that and say ‘If EA is willing to do this then they must know something we don’t,’” said Virgin Gaming co-founder Zachary Zeldin.
“We have been teaching developers about how we can be beneficial to their game, how we are going to keep users engaged in their product more, how we can roll out DLC for them and help sell more of this extra content, or how we can keep their games out of the second-hand shelves for six months longer.
“If Battlefield has a map pack that EA wants to release, we can run a $50,000 or a $100,000 tournament specific to that map pack. So now they have to buy that map pack.
“We are helping that community evolve.”
